    Terms & Conditions

    1. Agreement to Terms

    By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with any part of these Terms, you may not use our services. These Terms apply to all residential and commercial moving services provided by Rosh Elite Moving Group in the Greater Toronto Area and surrounding regions.

    2. Services

    Rosh Elite Moving Group provides professional residential and commercial moving, packing, and related services. The scope of services will be outlined in your moving contract or booking confirmation.

    2.1 Quotes & Estimates

    All quotes provided via our website, phone, or email are estimates based on information supplied by the client. Final pricing may be adjusted if:

    • The actual volume or weight of items exceeds what was disclosed at the time of quoting
    • Additional services are required on the day of the move (e.g., extra packing, additional stops, long carry distances)
    • Access conditions differ materially from what was communicated (e.g., no elevator access, excessive stairs, narrow corridors)

    Any price adjustments will be communicated to the client prior to or at the time of service. Binding estimates, where agreed to in writing, will be honoured as stated.

    2.2 Booking Confirmation

    A move is considered confirmed only upon receipt of a signed booking form or written confirmation and any required deposit. Rosh Elite Moving Group reserves the right to decline or cancel bookings at its discretion.

    3. Payment & Cancellation

    3.1 Payment Terms

    Payment is due upon completion of services unless otherwise agreed in writing. We accept cash, e-transfer, and major credit cards. Outstanding balances not paid within 7 days of invoice may be subject to a late fee of 2% per month.

    3.2 Deposits

    A deposit may be required to secure your booking date. Deposit amounts will be communicated at the time of booking. Deposits are non-refundable if a cancellation occurs within the notice period outlined in Section 3.3.

    3.3 Cancellations & Rescheduling

    Cancellation or rescheduling requests must be received in writing (email is acceptable). The following notice requirements apply:

    • More than 72 hours before the scheduled move: Full deposit refund or credit applied to a future booking
    • 24–72 hours before the scheduled move: 50% of deposit forfeited
    • Less than 24 hours before the scheduled move: Full deposit forfeited

    Rosh Elite Moving Group reserves the right to reschedule moves in the event of extreme weather, equipment failure, or other circumstances beyond our control. In such cases, no cancellation penalty will apply and a full refund or rescheduled date will be offered.

    4. Client Responsibilities

    To ensure a smooth and efficient move, clients are responsible for the following:

    4.1 Access & Site Conditions

    • Securing elevator booking, loading dock access, and any required building permits in advance
    • Ensuring adequate parking for moving vehicles at both origin and destination
    • Ensuring all pathways, hallways, and entry points are clear and accessible

    Failure to provide adequate access may result in additional wait time charges or rescheduling fees.

    4.2 Item Disclosure

    Clients must disclose all items to be moved at the time of quoting, including any items that are unusually heavy, fragile, or require special handling (e.g., pianos, antiques, artwork, safes). Failure to disclose such items may result in additional charges or refusal to move the item on the day of service.

    4.3 Prohibited Items

    Rosh Elite Moving Group will not transport the following items:

    • Hazardous materials including flammables, explosives, propane tanks, and chemicals
    • Perishable food items
    • Living plants or animals
    • Illegal substances or items
    • Items that cannot be safely loaded due to size, weight, or condition

    Clients are responsible for making alternative arrangements for prohibited items prior to the move date.

    4.4 Item Preparation

    Unless packing services are arranged with Rosh Elite Moving Group, clients are responsible for properly boxing, labelling, and preparing all items for transport. Items not properly packed may be declined for transport if our crew deems them a safety or damage risk.

    5. Liability & Valuation

    5.1 Standard Liability

    Our liability for lost or damaged items is governed by the specific terms of your moving contract and the valuation coverage option you select at the time of booking. In the absence of a selected valuation plan, our maximum liability is limited to $0.60 per pound per article in accordance with standard carrier liability under Ontario regulations.

    5.2 Released Value vs. Full Value Protection

    Clients may elect additional valuation coverage (Full Value Protection) at an additional cost, which must be selected and confirmed prior to the move. Rosh Elite Moving Group is not responsible for the replacement cost of items under Released Value coverage.

    5.3 Limitation of Liability

    To the maximum extent permitted by applicable law, Rosh Elite Moving Group's total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific move in question. We are not liable for:

    • Indirect, incidental, or consequential damages
    • Loss of income or business resulting from delays
    • Pre-existing damage to items not noted on the inventory form at the time of pickup
    • Damage to items packed by the client in client-supplied boxes
    • Damage resulting from access conditions outside our control

    5.4 Claims Process

    Any claims for loss or damage must be submitted in writing to info@roshelitemoving.ca within 5 business days of the move date. Claims submitted after this period may not be honoured. We will investigate and respond to all valid claims within 14 business days.

    6. Force Majeure

    Rosh Elite Moving Group shall not be held liable for delays or failure to perform services caused by circumstances beyond our reasonable control, including but not limited to: severe weather, road closures, natural disasters, labour disputes, government-imposed restrictions, or equipment failures. In such cases, we will make reasonable efforts to reschedule the move at the earliest available opportunity with no additional charge to the client.

    7. Communication & SMS Consent

    By providing your phone number and opting in through our website or booking form, you consent to receive text messages from Rosh Elite Moving Group regarding your inquiries, quotes, booking confirmations, appointment reminders, and service updates.

    • Message frequency will vary based on your booking status and interactions with our team
    • Standard message and data rates from your carrier may apply
    • You may opt out at any time by replying STOP to any message
    • Reply HELP for assistance or contact us at info@roshelitemoving.ca

    We do not sell or share your contact information with third parties for marketing purposes.

    8. Privacy

    Your personal information is collected and used solely for the purpose of providing and administering our moving services, including booking, billing, and communications. We handle all personal data in accordance with applicable Canadian privacy legislation, including PIPEDA. Our full Privacy Policy is available on our website.

    9. Dispute Resolution

    In the event of a dispute arising from our services, we encourage clients to first contact us directly at info@roshelitemoving.ca to seek a resolution. We are committed to resolving concerns in good faith within a reasonable timeframe.

    If a resolution cannot be reached informally, both parties agree to attempt mediation before pursuing any legal action. These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable laws of Canada.

    10. Governing Law & Jurisdiction

    These Terms and Conditions shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal proceedings arising from these Terms shall be conducted exclusively in the courts located in Toronto, Ontario.

    11. Changes to These Terms

    Rosh Elite Moving Group reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on our website with an updated revision date. Continued use of our services following any changes constitutes your acceptance of the revised Terms. For significant changes, we will make reasonable efforts to notify clients via email or SMS.
